You can sometimes recover crypto from scammers. You cannot assume that you will. The cases that move are the ones where the funds can still be found.
Sometimes yes: funds sitting on an exchange
If the scammer's funds are sitting on an exchange such as Binance, a civil application can ask the court to freeze that account. The same is true of other large exchanges. A freeze can lead to a return of funds. It can also stop a withdrawal while the case is heard. A freeze is not the same as money already in your bank.
Sometimes yes: stablecoins such as USDT and USDC
Stolen USDT or USDC can sometimes be frozen, returned, or, after a freeze, re-issued. That depends on the issuer, the exchange, and the quality of the tracing. Stolen Bitcoin and stolen Ethereum can be traced as well. They are harder to stop once they leave an exchange for a private wallet.
What to gather before you ask
- The transaction hash for each send
- The platform name and any wallet address you were told to use
- Screenshots of the balance and the withdrawal block
- Do not send a seed phrase, and do not pay a second "unlock" fee
Forensic tracing may be carried out by separate firms: AI Data Intelligence and its teams at EthGuardians and Blockchain Legal Solutions. A mandate with Swiss Lawmakers does not by itself instruct those firms. A tracing report can show whether stolen coins are still moving, or whether they are sitting at an exchange.
No professional fee is payable up front. Any percentage, and any court, forensic, or bank costs, are set out in a written mandate before that work starts. Recovery of funds is not guaranteed. We do not act for citizens or permanent residents of the United States, Germany, Italy, or France.
